| Terms & Conditions of Booking with Coaching In The Sun |

1. Governing Law
Your contract is with nu U coaching limited trading as Coaching in the Sun. The registered office of nu U coaching is 95 Longstomps Avenue, Chelmsford, CM2 9BZ. All contract terms and conditions are subject to the law of England.
2. Deposit, payment, supplements
We require a 20% non-refundable deposit per person. There is a 7 day cooling off period after making the deposit during which time the deposit is refundable should you change your mind for any reason and wish to cancel your booking.
Full payment is required six weeks before departure. Provided there is space, bookings can be accepted until the date of departure, but for bookings within six weeks of departure, immediate payment in full is required. Payment from abroad must be made by credit card, or by banker´s draft in £ sterling drawn on a UK clearing bank (and not by personal cheques)
3. Cancellations:
If you cancel: (a) More than six weeks before departure, the deposit is forfeited. (b) Less than six weeks before departure, the following percentage of the total fee is retained or payable, even if the balance remains outstanding: 4 - 6 weeks: 40%; 2 - 4 weeks: 60%; 1 - 2 weeks: 75%; less than one week: 100% of holiday and transfer fee retained or payable. In many cases, cancellation fees are covered by insurance.
Notification of the cancellation of the holiday must be given in writing to us immediately failure to do so may prejudice your entitlement to claim a refund. No refunds will be made once participants are at Coaching in the Sun.
4. Descriptions
All information included in our brochure and web site is correct to the best of our knowledge at the time of going to press. However, due to staff cancellations, weather conditions, low bookings, maintenance work, mechanical faults, or other situations outside our control, some amenities or courses described may become temporarily or permanently unavailable.We reserve the right to make any changes to our programme with regard to courses or facilitators. Alternative arrangements are offered to the best of our ability but, if not taken up, we do not accept responsibility for any costs incurred, including air fare.
We do not accept liability for any costs incurred as a result of any of the following: Cancellations, delays or changes caused by war, threat of war, closure of airports, civil strife, industrial action, natural disaster, technical problems with transport, or other events beyond our control including those mentioned in the preceding paragraph; participants´ medical or psychiatric conditions which may develop during or subsequent to the holiday; loss of, or damage to, personal property of participants. NB You must be insured on booking. We can arrange this for you. See link.We are not travel agents or flight carriers and therefore do not take responsibility for flight arrangements, delays or cancellations.
5. TRAVEL INSURANCE
Coaching in the Sun does not offer travel insurance. You should have adequate travel insurance for your holiday including cancellation charges.
6. Coaching Sessions
You acknowledge that all coaching provided under this agreement is undertaken completely at your own risk, that coaching sessions may address issues in relation to which you are experiencing strong emotion and that the Coach may ask personal and direct questions. You acknowledge that coaching may include discussion of your values, identifying plans of action, examining the operation of any aspect of your life, asking questions for the purpose of clarifying issues and making empowering requests
You further acknowledge and agree that as you are responsible for your own learning and implementing your action plans. For this reason Coaching in the Sun does not guarantee any results or provide any warranties. The Coaches shall not be responsible to you or any third party for any physical or mental condition or circumstance cased as the direct or indirect result of or related to the coaching services in any way. You agree to indemnify the Coach, Coaching in the Sun SL and nu U Coaching Ltd in relation to any claim made against them for loss or damage suffered as a result of your acts or omissions.
7. Therapies
Where you choose to partake in any of the Alternative Therapies (including but not limited to Reiki, Massage, Hypnotherapy, Reflexology and Aromatherapy) that may be available from time to time at extra charge you acknowledge that you do so at your own risk. Results of these therapies are not guaranteed by Coaching in the Sun, nor by any of the therapists. You agree to indemnify the therapist, Coaching in the Sun SL and nu U Coaching Ltd in relation to any claim made against them for loss or damage suffered as a result of your acts or omissions.
8. Materials
You agree that you do not own the intellectual property in any material supplied to you by Coaching in the Sun and that all such material is confidential, must only be used by you during coaching sessions for the purpose of being coached and cannot be disclosed to any other person.
9. Confidentiality
You and the Coaches agree to respect the confidentiality of any information given to each other during the coaching sessions. You agree that information may be shared amongst the Coaches for the purpose of gaining extra support both for yourself and for the Coaches so that a better service can be delivered to you. Information disclosed during one on one coaching sessions will be treated respectfully and not needlessly or wantonly repeated. The only exception to this confidentiality will be where required by the laws of either England or Spain.
You should be careful what information you disclose in group coaching sessions as other participants are not within the control of Coaching in the Sun and confidentiality cannot therefore be guaranteed.
10. Complaints
The whole of your holiday is delivered in Spain by Coaching in the Sun SL. Complaints about the delivery of your holiday should be made whilst in Spain to the staff and entered into the complaints book that is held there. All complaints will be investigated and where possible rectified whilst you are in Spain. Disputes that are not resolved before you leave Spain should be documented and sent to nu U coaching limited on your return through the registered office.
11. Completeness of this agreement.
This document represents the entire agreement between the parties, which may only be varied in writing and by agreement. |
